Possession with Intent to Distribute Subsequent Offense – Client was the subject of a Massachusetts State Police investigation into marijuana distribution. The state police investigated a package shipped from California containing what they believed to be marijuana. Police watched the client pick up the package. Police then stopped the client and brought a drug detection dog. The dog located the drugs, 38 pounds of marijuana. Client was arrested. In addition to the drugs client was also carrying close to $2,000.00 on him. Attorney Donovan argued that the case should be dismissed because of improper handling at the police station. Possession with Intent to Distribute- The client was charged with Possession of a Class D Drug With the Intent to Distribute after he took delivery of a package containing close to 15 pounds of marijuana.
