Reckless Operation of a Motor Vehicle- The client was stopped by a State trooper on the Mass Pike for passing his cruiser at high speed. The client was also driving a pick-up truck with the bed fill with many different items. Also, the trooper observed the client changing lanes and not signaling. The client was issued a criminal citation for reckless operation. Attorney Donovan’s investigation revealed the citation was not returned to the court timely. Because of that prosecutor dismissed the case prior to the arraignment.
The client was charged with operating to endanger in violation MGL c 90 s 24, after police were called by several neighbors that the client and another car were racing through and quiet neighborhood. Police called the client and he confessed to driving his car on that road. Police threatened to arrest my client yet decided to summons him for a clerk magistrates hearing. After much arguing, the clerk decided to not issue the complaint. CASE DISMISSED.
